These Terms govern your use of WritingMark (writing.naplanroo.com), operated by [BUSINESS NAME, ABN …]. By creating an account you agree to these Terms and to our Privacy Policy.
1. What WritingMark is
WritingMark is an AI writing-practice tool that estimates a NAPLAN-style score and gives feedback, an improved version, and a list of changes for a student’s essay.
- Scores and feedback are AI-generated estimates for practice only. They are not official NAPLAN results and are not a substitute for a qualified teacher or formal assessment.
- We make no guarantee of accuracy, nor of any particular grade or improvement.
- WritingMark is not an officially endorsed product of the NAPLAN program and is produced independently of Australian governments and ACARA. “NAPLAN” is a trademark of ACARA.
- Features may change, and beta features may be added or removed at any time.
2. Eligibility — adults & supervised students
The account holder must be a parent, teacher or guardian aged 18 or over. Students use the service under that adult’s supervision and consent. Provide accurate information; one account per person; don’t share accounts.
3. Plans, billing & auto-renewal
- Free: 2 marks per week; results delivered after a 24-hour wait; one essay at a time.
- Plus: $17.99/month (first month $8.99), or $120/year. Instant results, 5 marks/week.
- Pro: $39.90/month (first month $11.97). Instant, “unlimited” (fair use), plus extra features.
- Prices are in Australian dollars (AUD). Paid plans auto-renew each period until cancelled.
- Launch promotional pricing applies to the first month only; plans then renew at the regular price.
- We will give at least 30 days’ notice of any price increase.
4. Cancellation & refunds
You can cancel anytime; you keep access until the end of your current paid period, and the current period is not refunded (see Billing & Refunds). Nothing in these Terms excludes the consumer guarantees under the Australian Consumer Law.
5. Acceptable use
- No reverse engineering, scraping, or automated bulk access.
- No bypassing the paywall or usage limits.
- No unlawful, harmful, or infringing content; no impersonation.
- Breach may result in suspension or termination without refund.
6. Intellectual property
The product, software and design are owned by us. The writing you submit remains yours; you grant us a licence to process and store it to provide and improve the service. You may not use our name or logos without permission.
7. Disclaimers
The service is provided “as is”. To the extent permitted by law, we do not warrant that it will be uninterrupted or error-free, and we are not responsible for problems caused by third-party services (e.g. the AI provider or payment processor).
8. Limitation of liability
To the maximum extent permitted by law, our total liability is limited to the amount you paid us in the 12 months before the claim, and we are not liable for indirect or consequential loss (including lost data or profits). Nothing limits rights you have under the Australian Consumer Law that cannot be excluded.
9. Availability
We aim for high availability but do not guarantee a specific uptime; occasional maintenance or outages may occur.
10. Termination
We may suspend or terminate accounts that breach these Terms. You may cancel anytime. After account deletion, data is removed within 30 days (see Privacy Policy).
11. Governing law
These Terms are governed by the laws of [STATE, e.g. New South Wales], Australia, and you submit to the courts of that jurisdiction. Disputes: we’ll first try to resolve them with you directly within 30 days.
12. Changes
We may update these Terms; material changes will be notified in-app or by email.
