These Terms govern your use of WritingMark (writing.naplanroo.com), operated by [BUSINESS NAME, ABN …]. By creating an account you agree to these Terms and to our Privacy Policy.

1. What WritingMark is

WritingMark is an AI writing-practice tool that estimates a NAPLAN-style score and gives feedback, an improved version, and a list of changes for a student’s essay.

2. Eligibility — adults & supervised students

The account holder must be a parent, teacher or guardian aged 18 or over. Students use the service under that adult’s supervision and consent. Provide accurate information; one account per person; don’t share accounts.

4. Cancellation & refunds

You can cancel anytime; you keep access until the end of your current paid period, and the current period is not refunded (see Billing & Refunds). Nothing in these Terms excludes the consumer guarantees under the Australian Consumer Law.

6. Intellectual property

The product, software and design are owned by us. The writing you submit remains yours; you grant us a licence to process and store it to provide and improve the service. You may not use our name or logos without permission.

7. Disclaimers

The service is provided “as is”. To the extent permitted by law, we do not warrant that it will be uninterrupted or error-free, and we are not responsible for problems caused by third-party services (e.g. the AI provider or payment processor).

8. Limitation of liability

To the maximum extent permitted by law, our total liability is limited to the amount you paid us in the 12 months before the claim, and we are not liable for indirect or consequential loss (including lost data or profits). Nothing limits rights you have under the Australian Consumer Law that cannot be excluded.

9. Availability

We aim for high availability but do not guarantee a specific uptime; occasional maintenance or outages may occur.

10. Termination

We may suspend or terminate accounts that breach these Terms. You may cancel anytime. After account deletion, data is removed within 30 days (see Privacy Policy).

11. Governing law

These Terms are governed by the laws of [STATE, e.g. New South Wales], Australia, and you submit to the courts of that jurisdiction. Disputes: we’ll first try to resolve them with you directly within 30 days.

12. Changes

We may update these Terms; material changes will be notified in-app or by email.
